General Terms and Conditions (GTC) - BLG Sports GmbH as of August 1, 2023

 

All BLG Sports services are subject to the General Terms and Conditions, unless these have been modified or supplemented by written agreements.

 

1. Scope
The following general terms and conditions regulate participation in personal training and group courses at BLG Sports GmbH, based in 8005 Zurich, Switzerland (hereinafter referred to as "BLG Sports"). By registering and participating in our offers, you accept these terms and conditions in their currently valid version.

 

2. Registration and conclusion of contract
2.1. Registration for personal training or group courses can be done in person in our studio, by telephone or online.
2.2. By registering, you are making a binding offer to conclude a contract. The contract is concluded as soon as we confirm your registration in writing, online or verbally.
2.3. BLG Sports reserves the right to reject registrations without giving reasons.

 

3. Services and prices
3.1. The exact service descriptions for personal training and group courses can be found on our website or in our current offers.
3.2. The prices for our services are also published on our website or in our current offers. The prices valid at the time of registration apply.

3.3. If the prices change after the contract is concluded, existing contracts will remain unaffected. However, price changes will be announced in good time.

 

4. Terms of payment
4.1. Payment for personal training and group courses must be made in advance unless otherwise agreed.
4.2. In the event of late payment, participation in the training may be prohibited until full payment has been received.

 

5. Withdrawal and cancellation
5.1. You have the right to withdraw free of charge up to 14 days before the start of the training. Withdrawal must be made in writing or by email.
5.2. If you cancel within 14 days before the start of the training or if you do not appear at the training, the full course fee will be due, unless there are special reasons (e.g. illness or accident, upon presentation of a medical certificate).
5.3. Customers who cancel their training session more than 12 hours before the agreed date are not entitled to a refund of the course fee.

 

6. Changes and cancellations of training sessions
6.1. BLG Sports reserves the right to cancel group courses if the number of participants is too low. In this case, course fees that have already been paid will be refunded or can be credited towards other courses.
6.2. BLG Sports reserves the right to make changes to the training plan if necessary. Course fees that have already been paid remain unaffected.

 

7. Liability
7.1. Participation in the training courses is at your own risk. BLG Sports assumes no liability for accidents or injuries during training, unless these are due to gross negligence or intent on the part of BLG Sports or its employees.
7.2. Before the training begins, the participant is obliged to inform the trainer of any health restrictions or problems in order to be able to adapt participation in the exercises accordingly.

 

8. Data protection
8.1. Data processing is carried out in accordance with the applicable data protection regulations. Information on data processing and storage can be found in our data protection declaration, which can be viewed on our website.

 

9. Severability clause
If individual provisions of these terms and conditions are or become ineffective, the effectiveness of the remaining provisions remains unaffected. The invalid provisions will be replaced by a regulation that comes as close as possible to the economic meaning and purpose of the invalid provision.

10. Photo and Video Recordings

During training sessions or courses, BLG Sports may occasionally take photo and video recordings for documentation and marketing purposes (e.g. website, social media, promotional materials).

By participating in our training sessions, participants acknowledge that such recordings may be made in which they may appear.

If a participant does not wish to appear in photo or video recordings, they may inform the trainer or BLG Sports staff at any time. We will of course respect this request and ensure that the person concerned is not included in future recordings where reasonably possible.

Applicable Law and Jurisdiction

Swiss law applies to these General Terms and Conditions and all legal relationships between you and BLG Sports. The exclusive place of jurisdiction is 8005 Zurich.
